These Terms of Service ("Terms") govern your use of Perpetual Picks (perpetualpicks.com, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Perpetual Picks is a free, informational tool that analyzes publicly available sports betting market data and surfaces algorithmically generated observations. It is for entertainment and informational purposes only.
You must be at least 21 years of age (or the age of majority for gambling-related content in your jurisdiction, whichever is higher) to use the Service. By using the Service you represent that you meet this requirement and that using it is lawful where you live. You are solely responsible for complying with the laws of your jurisdiction, including any laws regarding sports wagering.
If you choose to gamble, gamble responsibly and only with money you can afford to lose. If you or someone you know has a gambling problem, call 1-800-GAMBLER or visit the National Council on Problem Gambling at ncpgambling.org.
You are responsible for maintaining the confidentiality of your password and for all activity under your account. Usernames must not be offensive, impersonate others, or infringe anyone's rights; we may reclaim or disable any account or username that violates these Terms. You may delete your account at any time from Account Settings.
You agree not to: (a) access the Service by automated means (scraping, bots) or circumvent rate limits or security measures; (b) resell, redistribute, or commercially exploit the Service's data or output; (c) use the Service to violate any law; or (d) interfere with the Service's operation or other users' access to it.
The Service is provided free of charge and on an "as available" basis. Odds data comes from third-party sources and may be delayed, incomplete, or inaccurate; always confirm any price at the sportsbook before acting on anything. We may modify, suspend, or discontinue any part of the Service at any time without notice.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERPETUAL PICKS AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY GAMBLING LOSSES, LOST PROFITS, OR LOST DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100). ANY WAGERING DECISION YOU MAKE IS YOURS ALONE.
You agree to indemnify and hold harmless Perpetual Picks and its operator from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-law principles.
